2024 NSMBA Challenge Terms and Conditions

This NSMBA Trails for All Challenge (the “Contest”) is governed by the following rules (the “Official Rules”).

By participating or attempting to participate in the Contest, you will be deemed to have received, understood, and agreed to these Official Rules.

Although the Contest may be promoted, communicated, or administered by means of a third party, including but not limited to a social media or social networking service or site (a “Third Party Service”), the Contest is not sponsored, endorsed, administered by or associated with any Third Party Service. For greater clarity, Third Party Services include but are not limited to the following: TrailForks, Instagram, Twitter, Pinterest, LinkedIn and Facebook. The Contest is sponsored and administered by the North Shore Mountain Bike Association (NSMBA). Any questions, comments or complaints regarding the Contest should be directed to NSMBA and not to any Third Party Service.

  • ELIGIBILITY?

The Contest is open only to residents of British Columbia who have reached the age of majority in their jurisdiction of residence as of the date of entry.

The following individuals are eligible to enter the Contest but ineligible for the badge prizing : NSMBA employees, officers, and directors of: any prize suppliers;

  • WHEN DOES THE CONTEST BEGIN/END?

The Contest begins at 12:01 AM. Pacific Time on February 1, 2024, and runs until February 29, 2024 11:59PM Pacific Time (“Entry Period”). 

During each day of the Contest, eligible individuals will be able to enter to win the prizes set out at the bottom of these Official Rules (the “Prizes”)

  • HOW DO I ENTER THE CONTEST?

To enter the Contest, take the following actions:

  1. Add the Trails for All Challenge to your cart and check out. 
  2. Fill in the Google Form (this is important so we can track you and ensure you receive prizing if you win). 
  3. Join the Challenge on Trailforks. 

You must track your activity via Trailforks for each day of the Contest. You must track 29 minutes each day to be eligible for any prizing. 

If you don’t already have or use Trailforks, you can download a free version that allows you to track your activities in one region

You are solely responsible for ensuring that your entry or entries are properly submitted (including by properly completing any required registration fields).

  • COULD MY ENTRY BE REFUSED OR REJECTED?

Your entry could be refused or rejected if:

  1. a) you fail to meet the Contest’s eligibility criteria;
    b) your entry contains false or misleading information, or is late, falsified, illegible, or incomplete or otherwise irregular;

In addition, NSMBA reserves the right to refuse any entry for any other reason in its sole discretion.

  • WHAT ARE THE ENTRY CONDITIONS and HOW DO THE RELEASEES LIMIT THEIR LIABILITY?

By entering the Contest:

  1. a) you agree to be bound by these Official Rules and by the decisions of NSMBA, which decisions are final;
    b) you agree that NSMBA shall have the right at any time to require proof of identity or eligibility to enter the Contest; failure to provide any such proof upon request may result in disqualification;
    c) you release and forever discharge NSMBA, its respective affiliates, and subsidiaries, and all of their respective directors, officers, employees, agents, representatives, licensees, successors and assigns, as well as any Third Party Services, (collectively, the “ Releasees”), and agree to indemnify and hold harmless each of the Releasees, from and against any and all claims, damages or liability, including any costs or losses related to personal injury, death, damage to or loss or destruction of property, arising out of, or in any way related to, (i) your participation in, or inability to participate in, the Contest, (ii) the awarding, receipt, possession, use, redemption or misuse of any prize, in whole or in part, or activity related to any prize, or your inability to receive, use or redeem any prize; (iii) your failure to comply with these Official Rules, or (iv) any breach of these Official Rules.
  2. NSMBA Staff and Directors are not eligible for prizing.

NSMBA will not be liable to you for any indirect, special, consequential, or punitive damages in connection with the Contest or these Official Rules.

  • ARE THERE ANY PRIZE CONDITIONS?

In addition to any prize conditions provided elsewhere in these Official Rules, any prize awarded in the Contest is subject to the following conditions:

  1. a) The prize must be accepted as awarded, and will be awarded to the confirmed winner only.
    b) NSMBA reserves the right to substitute any prize in whole or in part in the event that all or any component of the prize is unavailable, with a prize of equal or greater retail value.

Prizes may be subject to additional terms and conditions as imposed by prize suppliers.

  • HOW WILL THE POTENTIAL WINNER(S) BE SELECTED?

NSMBA will conduct random draws corresponding to the Prizes from among all eligible entries received. NSMBA will then contact the winners of the prizes. If any potential winner does not respond to such notification within three (3) business days, declines a prize for any reason, or does not meet the requirements set forth in these Official Rules, as determined by NSMBA, the potential winner will be disqualified and, at NSMBA’s discretion, an alternate potential winner may be randomly selected from among remaining eligible entries, or the prize may be canceled.

  • HOW CAN A POTENTIAL WINNER BECOME A WINNER?

To be declared a winner, a potential winner:

  1. a) must comply with these Official Rules;
    b) may be required to provide proof of identification to confirm eligibility or to claim a prize.
  • WHAT ARE THE ODDS OF WINNING A PRIZE?

The odds of winning depend on the number of eligible entries received.

  • HOW DO I CLAIM A PRIZE?

Once a potential winner is confirmed as a winner, prize distribution will be promptly coordinated. Except as otherwise indicated by NSMBA, a winner must personally pick up the prize before March 31st, 2024 at the place in which NSMBA will announce when the contest commences.

If a winner fails to pick up the prize as instructed, the prize will be deemed forfeited.

  • WILL I APPEAR IN ANY PUBLICITY IF I AM A WINNER?

If you are a winner, NSMBA will confirm your consent to appear in publicity related to the Contest or any similar contest.

  • HOW WILL MY PERSONAL INFORMATION BE COLLECTED, USED AND DISCLOSED?

By entering the Contest, you consent to NSMBA’s collection, use and disclosure of your personal information for contest details only, e.g. contacting you if you won a prize or sharing on social media. If you click “yes” to join the NSMBA newsletter, you will be added to this list. Otherwise, your personal information will not be shared with any third parties. 

  • WHAT LAWS APPLY TO THE CONTEST?

The Contest and these Official Rules are governed by the laws applicable in British Columbia. Any disputes, claims or causes of action arising out of or connected with the Contest, prize or these Official Rules will be resolved individually, without resort to any form of class action, and exclusively by the appropriate court of British Columbia, Canada.

  • CAN NSMBA CANCEL OR AMEND THE CONTEST?

NSMBA may cancel, modify, or suspend the Contest or amend these Official Rules for any reason without prior notice.

The prize packs available to win will be announced when the contest goes live and you can see prizes outlined on Trailforks or the NSMBA website.
